Statewide Referendum: SJR 116
SJR 116: Prohibit Partial Veto to Increase a Tax or Fee
What it would do:
This amendment would prohibit the Wisconsin governor from using the partial veto to create or increase a tax or fee, or to authorize the creation or increase of one.
Potential impacts on the business community:
The amendment directly relates to state taxation, fees, government budgeting, and the balance of power between the Legislature and governor. If approved, a governor could no longer use the partial-veto authority to create or increase a tax or fee. This could affect how future tax and fee changes are enacted and would place a constitutional restriction on one method of changing state fiscal policy. For businesses, the amendment is particularly relevant when monitoring state budgets, taxes, fees, and government spending.
The amendment follows a dispute over the scope of Wisconsin’s partial-veto power. A 2023–25 budget veto by Gov. Tony Evers increased school revenue limits for a very long period, which subsequently became the subject of litigation.
Bottom line:
The amendment would make clear in the Wisconsin Constitution that the governor’s partial veto cannot be used to create or increase taxes or fees.
